We are happy to receive you on our website : www.bonjourmoncoussin.com (hereafteer referred to as the “Site”.) The present conditions apply, on the one hand, to the society “LES MECANOS SARL”, RCS 509 310 538 situated at 59 bis cours Victor Hugo, Bordeaux 33800, FRANCE, hereafter referred to as “Bonjour mon coussin” and on the other hand, person(s) wishing to purchase on the internet site of Bonjour mon coussin, hereafter referred to as “the client”. These general conditions of sale apply exclusively to the sale of products presented on the site. They are systematically available to the client on the present site when the order is registered. Their objective is to define the conditions of sale between Bonjour mon coussin from the placing of the order to the final delivery, including conditions of payment. They control all the necessary steps for placing an order on line and ensure the follow-up of the order between the two contracting parties. These conditions apply exclusively to natural persons and not to business persons.

1. The Order

An order registered on the site can only be valid once the client is clearly identified. All orders presuppose acceptation of the price and the description of the products for sale. Bonjour mon coussin undertakes to honour the orders received via the site within the limits of available stocks. If the article is no longer available, you will be informed as soon as possible and the delay for reception of the product will be indicated. If you so wish, you may then cancel the order (refund by cheque within 15 days) or change your order by contacting us either by phone: +33 (0)5 57 78 29 33 or by mail: 59 bis, cours Victor Hugo, Bordeaux 33000, FRANCE.

2. Price - Payment

The prices given on the site are in Euros, all taxes included, but not your participation in transport costs. Prices may vary in the course of the year. Products ordered are charged at the price ruling at the time when the order is registered. The products remain the property of Bonjour mon coussin until payment has been effected. All orders placed on the site must be paid for exclusively in Euros and by cheque or by credit card. Maximum security is ensured for all payments made on line by credit card when placing an order. The entire transaction is directed in encrypted mode towards the bank validation server in SSL mode (Secure Socket Layer). You can make your purchases with complete security.

3. Delivery

The client may choose where delivery should be made, at the address given for payment or at a different address. Bonjour mon coussin undertakes to deliver the articles with minimum delay by “colissimo suivi”. Postage costs : Metropolitan France, Andorra and Monaco : 5,30€ up to 500 gms; 6,50€ up to 1 kg; 7,40€ up to 2 kg; 8,30€ up to 3 kg. Europe, Switzerland and Norway : 15,60€ up to 1kg; 17,50€ up to 2 kg; 20,75€ up to 3 kg. Other destinations on estimate : please get in touch with the client service. No dispatches on Sundays and public holidays. Delays in delivery do not justify claims for damages with interest. In case of loss or damage, the addressee must take legal steps against the transporter within a delay of 72 hours as prescribed by article 105 of the commercial code.

4. Guarantee

All orders are checked twice before dispatch. In case of an error in the quantity or of defective goods, reclamation must be made to Bonjour mon coussin within 48 hours after reception. Beyond that delay no claims will be considered. In case of a legitimate claim, we will replace the faulty article. If we cannot replace the article, you may either choose another article or demand a refund. All articles may be exchanged if not washed. The exchange must take place within 15 days after the date of reception. The client returns the article to be exchanged at his own expense and Bonjour mon coussin will pay postage an the replacement article. The payment of postage by Bonjour mon coussin for an exchange is limited to once per client and per order. If the new order is more expensive than the one returned for exchange, the client must pay the difference when making the second choice. If the second article is cheaper than the original choice, the client will receive a cheque for the difference. 5. Signatures and Proofs

Supplying, on line, the number of the credit card and the final validation of the order, serves as proof positive for the whole of that order in accordance with the law of 13 March, 2000, as well as liability for the total amount involved as payment for all the articles on that order form. Such validation is equivalent to a signature and formal acceptance of all the operations effected on the site. PROOF : The computerized registers kept in the computer system of Bonjour mon coussin under conditions of reasonable security, will be considered as proof of the communications, orders and payments concerning the two parties. ELECTRONIC CONSERVATION AND STORAGE OF TRANSACTIONS : The storage of order forms and accounts is effected on a reliable durable support in such a way as to correspond to a faithful and durable copy in accordance with article 1348 of the civil code.

6. Responsibility

For all the stages of access to the site, placing orders, delivery or ulterior services, the society Bonjour mon coussin has only the obligation of the means. Bonjour mon coussin cannot be held responsible for any inconvenience or damage inherent to the use of Internet, notable the interruption of services, an exterior intrusion or the presence of information viruses or any other factor beyond their control, in accordance with current jurisprudence.

7. Registered particulars

The client is informed that the automatic treatment of information, notably the management of e-mail addresses of clients, has been the subject of a declaration to the CNIL under the number (in progress). According to the law of 6 january 1978 the client has the right of access to, and correction of these particulars.

8. Duration

The present conditions apply throughout the duration of the offer of active services by Bonjour mon coussin.

COMPETENCE AND APPLICABLE LAW

The current conditions are subject to French Law. In the case of litigation and failure to reach an amicable solution between the parties, competence will be attributed to the competent tribunal at Bordeaux, notwithstanding plurality of defenders and/or appeal in garanty even for urgent procedures or protective summary procedures or by petition.
